Failure to post agenda causes P&Z meeting to be canceled

BISBEE - The Cochise County Planning and Zoning meeting that was scheduled for Wednesday was canceled after an employee forgot to post the meeting notice.


The dockets will be included on the agenda for Nov. 14.

County Planning Department Director Judy Anderson canceled the meeting since no one on staff posted the public meeting notice or the agenda on the message board outside of the county supervisors building or on the county Web site.

"An employee forgot to put up the notice," she said.

"After checking with our county attorney and with the Attorney General's Office, we determined that it was best to cancel the meeting."

According to Arizona Open Meeting Law, notices for public meetings must be posted in two places 24 hours or more before the meeting's scheduled time. If the Planning and Zoning Commission members had gone ahead with the meeting, any actions they may have been taken would be up for question or even voided.

County resident Mike Jackson had been in communication with Anderson about the lack of any information on the county Web site.

"In October 2006, Anderson began following the Open Meeting Law," Jackson wrote in an e-mail to the Herald/Review.

"She stated that her new policy was to post agendas both on the 'meeting wall' outside the county offices in Bisbee, and on the county Web site. Every month since then, Anderson has followed that policy and the public has been able to find the agenda posted on the county Web site. But that stopped for the Oct. 10, 2007, P&Z Commission meeting. As of 7:30 p.m. the day before, no agenda has been posted on the county Web site, and the public which relies on the county Web site to see the agendas has been unable to do so."

Anderson confirmed Jackson had brought the matter to her attention.

The November meeting may end up being a long one if the four dockets - one has been postponed until the December meeting - that were to be heard Wednesday night are added to the agenda.

Anderson was not sure if commission Chairwoman Karen Corey will call for a second meeting next month or not, but that is a possibility. Since some dockets require more time for discussion and public comment, the commission members decided earlier this year to scale down the agendas and hold a second meeting on the fourth Wednesday of the month if warranted.
