Elfrida – An evidentiary hearing was held Tuesday morning for Richard Anderson, a Valley Union High School math teacher who is accused of both allegedly using sexually inappropriate language with a student and of touching the student on the thigh.

Richard Anderson, left, and his attorneys listen to testimonies from teachers and staff at Valley Union High Tuesday afternoon. Anderson is accused of inappropriate behavior with a student.

The language that Anderson, 43, allegedly used with the student after he touched him on the thigh was, “It will make your eyes roll back in your head.”

The student, whose name was not released, is known only as Student A.

Anderson is on paid administrative leave.

Attorneys for Anderson, the Valley Union School Board, and the prosecution listened to testimonies from current and former teachers and staff, all of whom testified to Anderson’s good standing and character.

Principal Rusty Taylor said Anderson had received high marks on his evaluations and performance.

He told the board and the attorneys he had never heard the “eye rolling in the head” phrase used in a sexual context.

For Taylor, “eyes rolling in the head” was a gesture of boredom.

Anderson’s attorneys asked Taylor if Anderson was a strict teacher and Taylor responded that he was tough.

“I respect him for making students accountable for their education,” he said.

English teacher Laura Miller also had high praise for Anderson. Miller said the eye-rolling phrase came about from a Sunday comic strip that would eventually become Anderson’s generic, catchall phrase for a variety of situations, ranging from boredom to exasperation.

Miller was asked if Anderson kept a proper distance with his students. Miller said he never relaxed his professional distance with his students.

Deputy Cochise County  Attorney Candace Pardy  asked Miller if it was appropriate that a teacher allow a student to shower in a teacher’s home.

Miller said it depended on the situation. Many students there often times work for teachers and so allowing the students to use the facilities to clean up was appropriate.

Former teachers and staff Muriel Metcalf and Shirley Ortega also took the stand and spoke well of Anderson’s professionalism. Both Metcalf and Ortega said the eye-rolling phrase carried no sexual connotation.

The attorney’s and school board moved into a close session to listen to four student’s testimonies. Those testimonies were not released to the public.

Anderson’s attorney’s also read excerpts from statements made by 13 students, all praising Anderson’s merits as a teacher and as an individual.

The hearing will resume and conclude on Nov. 19 in which the school board and attorneys will issue their decision.

The charges and evidentiary hearings against Anderson stem from a Sept. 7 Cochise County Sheriff’s investigation in which Anderson was accused of touching Student A on the leg. According to the Sheriff’s report, Anderson took a photograph of Student A when the student was in boxer shorts and preparing for sports practice.

In the report, Anderson would remind Student A of the photograph and tell him that the photograph was pinned to Anderson’s bathroom wall and that he would masturbate to Student A’s photograph.

" i totally agree with Mrs. Smith. There are nothign more than allegations at this time. What is a local writer doing publishing possibly false accusations in a paper like this? EXTREMELY UNPROFESSIONAL AND DISTURMBING. Even if it was proven true, I do not believe that the Dispatch be the place these precise details are publicized. And I have yet to see an apology like I am sure MANY persons including Anderson is waiting on. "

" Mr. Anderson is a great teacher! He unlike many others at Valley Union cares about the well being of his students. He pushes them to succeed and applauds them in victory. I am sorry to say that the only reason this situation is going this far is because some people do not like Mr. Anderson and they are using this situation (that has been blown compleatly out of porportion) to make themselves feel better. There have been some pretty bad situations at that school that no one ever though to speak up about. Why this? "

YOU SHOULD HAVE BEEN THERE wrote on Nov 2, 2007 10:36 PM:

" If any of you are in question to Mr. Anderson's innocence then you should have been there for the hearings. You would have heard all the lies and changing of their stories and you would have not had to judge off of a newspaper article or rumors...you would know in your heart that this is nothing but a witch hunt. " To the "concerned" comments: The reason there's a hearing is that the teacher wouldn't "go quietly;" that doesn't prove guilt. Testimony about last year's slap describes it more like a "brush" to the face. As to the "thigh," testimony is that the hand was about 4" above the knee--not quite the thigh. Finally, the "masturbation" comment is unproven. Why not focus on the "judge" who's staying on the panel despite a sworn affidavit that she said she would rule without regard to the evidence? How could anyone trust a "guilty" verdict in these circumstances? "

" I am sorry if Mr. Andersons career is trouble, but my concern is for the students future. I don't see how anyone can say that his comment had no sexual connotation when his hand was on the students thigh, and we are not privilege to the whole comment. How can someone pass off the other masturbation comment?! "

" If the evidence supports him being innocent then please explian why this matter is not solved. A picture is worth a thousand words. If this matter was over two young female students I don't think that he would be having the support that people thinks he has. I wonder, if he is such a good guy then why would he slap a student like he did last year. Maybe the real Mr. Anderson should stand up. Would you want your SON or daughter to really be put into this situation. "

" I think all this " Student A " wants is attention and to cause riot. He is ruining the reputation of a noble man and causing false accusations against him. Not only ruining his reputation, but ruining his life as well. This student is definitely turining this story around and adding his/her own two sense, basically causing chaos. "

" The evidence given in public by the school is weak--and before any evidence was produced, Anderson's attorneys presented a witness's affidavit that one of the school board "judges" indicated that her mind was already made up.-----The proceedings are probably null and void for violations of Arizona's Open Meeting Law, e.g. no internet notice of day 1, and public notice saying Wednesday's session would start 12 hours after it really did.-----County Supervisor Searle, a "judge" here, has repeatedly asserted that a decision will likely be reversible on appeal. What a shameful waste of public time and money. "

" Mr. Anderson is the BEST teacher Valley Union has ever had! Mr. Anderson is very professional, an extremely effective teacher and abides by all rules and regulations. Those of you who truly know Mr. Anderson, know in your heart that these are false accusations. "

" Mr. Zaragoza gave accurate account of the day's proceedings but his last two paragraphs were inappropriate and very unprofessional. Your act was irresponsible and a retract (front page / center) should be run issuing an appology and account of the testimony that proves this to be a false accusation. By disclosing this graphic information you have publicly accused and tainted the reputation of an innocent man. The mere mention of sexual immorality of a teacher ruins lives and careers even when innocence is proven. You have a responsibility...Do the right thing! I'll be watching. "
