BISBEE — Jury selection for the trial of a U.S. Border Patrol agent charged with murdering an illegal immigrant near Naco will start on Feb. 26.

Nicholas Corbett, who is charged with second-degree murder, manslaughter and negligent homicide of Francisco Dominguez-Rivera, will be tried in U.S. District Court in Tucson.

Judge David C. Bury issued an order dated Wednesday canceling an evidentiary hearing that had been scheduled for Feb. 25 at 1:30 p.m. Instead, a pretrial conference and a motions hearing will be held at that time.

Lead defense attorney Sean Chapman filed a notice to the court on Tuesday indicating that he and special prosecutor Grant Woods understood the trial would begin with jury selection on Feb. 27.

However, Bury’s order says jury selection will begin at 9:30 a.m. on Feb. 26.
