Judge: immigrants’ lawsuit stands

TUCSON (AP) — A federal judge has denied a southern Arizona rancher’s motions to dismiss a civil lawsuit on behalf of illegal immigrants who alleged that he detained, assaulted, battered and threatened them.


U.S. District Judge John Roll ruled that there was sufficient evidence for a reasonable jury to find in favor of 16 men and women who sued Roger Barnett.

Barnett has gained notoriety for detaining thousands of illegal immigrants on property he owns or holds grazing rights to.

The lawsuit also named Barnett’s wife and brother.

Last month, a state appeals court denied Barnett’s appeal after a jury found him liable for assaulting a family of Mexican-Americans who were hunting on state land near his ranch.

Attorney David Hardy, who represented Barnett on the appeal, did not immediately return a call for comment Friday.

    " Judge Roll should be disbarred and removed from his judgeship immediately. What he has done in this Barnett case amounts to treason against the United States and he should be brought up on charges of treason. "
