Douglas man arraigned for smuggling 61 pounds of pot through Douglas port

A Douglas man was arraigned Monday afternoon in connection with transporting marijuana through the Douglas Port of Entry.


Roy Aguirre, 39, of the 1900 block of 13th Street, was arrested at the port with 61.2 pounds of marijuana on November 23, 2007.

Aguirre was arraigned in the Cochise County Superior Court.

He is being charged with possession of marijuana for sale, a Class 2 felony; transportation of marijuana for sale, a Class 2 felony; and importation of marijuana for sale, a Class 2 felony.

Aguirre’s trial date is scheduled for Aug. 26, 2008.

On November 23, 2007, at about 4:15 p.m., Aguirre was traveling northbound in a blue Ford Expedition at the Douglas Port of Entry when he pulled up to a port inspector.

According to court documents, Aguirre at that time was wearing a T-shirt and a ball cap.

Aguirre was allegedly doing windshield repair in Agua Prieta for an area glass repair company, and that he was now doing the paperwork, the court document stated.

The inspector ordered Aguirre to secondary inspection.

At secondary inspection, Aguirre could not stop talking to the inspectors and was not paying attention to inspectional routine questions, the court document stated.

At that time a sniffing-dog hit positive for narcotics in the inside of the Expedition. Aguirre was then escorted to the pat-down room.

Inspectors found eight packages in the center console of the Expedition, 14 packages near the back seat and 19 packages in the bottom of the back seat, totaling 61.2 pounds of marijuana, the document said.

According to the court documents, Aguirre told the inspectors that he was approached by a man named Reyes, a man whom Aguirre had met only a few times.

Reyes asked to borrow Aguirre’s Expedition for about one half hour. Reyes told Aguirre that he would give him $1,000 to take the vehicle five blocks to the Auto Zone automotive store on 3rd Street and Pan American, the document stated.

Reyes would then walk to Auto Zone and pick up the vehicle.

Aguirre was arrested without incident. He has a pre-trial conference on June 27.

    " Unfortunately for Mr. Aguirre he will have to live with his error for the rest of his life. Things like this happen more often than one might expect. There are quite a bit of more severe crimes that occur in Douglas. I certainly agree with a previous comment that the DDD should not focus on this one event. Mr. Aguirre should try to deal with what happened and try to move on as best as possible. "
