BISBEE — The attorney representing a man charged with assaulting a Border Patrol agent who shot his dog in Bisbee Junction last year has filed a  notice of change of plea hearing in U.S. District Court in Tucson.

Gil Nelson jumped on Agent Jeremy Poser’s neck, put him in a headlock and sprained a finger in April of last year. Poser had responded to an activated sensor in a wash near Nelson’s home and shot his dog.

In the notice dated Wednesday, defense attorney Matthew Green says Nelson will appear for the change of plea hearing before Magistrate Judge Bernardo Velasco on Tuesday at 9 a.m., “or as soon thereafter as counsel may be heard.”

" Seems like a very brutal and uncaring act to shoot somene's dog just because he was found to trip a wash sensor. Would this officer do the same to a human? A child? I think an apology is in order rather than pressing charges. Federal, state & county servants need to keep in mind just WHO pays their salaries and to follow the law & procedure to the letter. Where in his manual does it say to shoot citizen's dogs? "

" Just goes to show you that you're a moron when you generalize a Federal Agency that protects this country. BP lives are put at risk everyday and Nelson is lucky he didn't get shot. Funny how some value the life of a dog more than a human being. Especially a human being that is paid and trained by your federal dollars. "

" Are you saying that you wouldn't shoot a dog that was charging at you to attack you? You should read more than the Douglas Dispatch, then maybe your comments wouldn't be as ignorant. "

" TO B. I hope you have neighbors that own dogs or yours turn on you some day and bite you. You don't know the status of the case but are quick to pass judgement on the federal employee. Typical anti law Douglas resident that makes heroes of the law breakers in town. And before you make more ignorant comments NO I'm not a FED employee just Douglas native. "

" I'd attack someone who shot my dog too!!! The agent got what he deserved and is a jerk for filing charges against Nelson. Just goes to show you how "federal employees" use their power. "
