May 14 city council agenda reviews annexation, property purchase

A special meeting and a regular city council meeting will be held Wednesday at the council chambers at 425 10th Street.


The Cochise County Fairgrounds are in the city council’s sites for annexation during the May 14 meeting.

The special meeting will be held at 3:30 p.m. The council will call for an executive session meeting and discuss the possible sale or lease of property located at 1701 10th, which relates to the government center plaza.

In the regular meeting the council will discuss, among other items on the agenda, the annexation of the Fairgrounds and North Golf Course Road and the buy-back of property on Pan American, between 11th Street and 12th Street, from the Sueño Americano Foundation.

The council will discuss first reading of Ordinance 08-933, which annexes the Fairgrounds and North Golf Course Road. At a Oct. 10 and Nov. 14, 2007 Council meeting, the Council approved pre-annexation agreements with the Cochise County Fairgrounds Association and Maddux and Sons Sand and Gravel. On Feb 13, 2008 the Council approved a pre-annexation agreement with MT-600 LLC and authorized the staff to proceed with the annexation of the area.

The council will also discuss the buy-back of the property on Pan American. The representatives of Sueño Americano have informed the City that they will be unable to proceed with the construction of the Mexican Consulate office on the property. They had purchased the property from the City on August 21, 2007. The property is part of the proposed Government Plaza project and the City is recommending that it buy the property for the original asking price of $100,000.

In other action the council will discuss:

√ Second reading of Ordinance 08-925, which pertains to the maximum height restrictions of wireless communication towers and joint use.

√ Second reading of Ordinance 08-926, which authorizes the City to accept the donation of 0.124 acres of land from MT Development LLC located west of Leslie Canyon Road and Fairway Drive.

√ Second reading of Ordinance 08-927, which relates to floodplain management and adopts the “City of Douglas Floodplain Management Plan 2008.”

√ Second reading of Ordinance 08-928,which adopts the NFPA-1, uniform fire code of the National Fire Protection Association.

√ Second reading of Ordinance 08-929, which relates to the privilege license tax.

√ Second reading of 08-930, which authorizes the City to acquire from Tash Revocable Trust a  vacant lot between 8th Street and 9th Street and Rose Avenue.

√ Second reading of Ordinance 08-931, which extends the transaction privilege tax of one and one-half percent on single item purchases of tangible personal property exceeding $10,000 from June 30, 2008 to June 30, 2010.

√ First reading of Ordinance 08-932, which relates to open burning.

√ First reading of Ordinance 08-934, which relates to the magistrate court and surcharges levied on unpaid fines to cover collection agency fees.

√ Approval of Resolution 08-549, which grants a permanent 30-foot water and sewer easement from Freeport-McMoran corporation to the City for installation and maintenance of water and sewer lines together with other improvements, equipment and appurtenances at the proposed 3rd Street right of way.

√ Resolution 08-552, which authorizes an intergovernmental agreement between the City and the Arizona Department of Transportation for the maintenance, electrical power and cost responsibilities for the traffic signal at the intersection of SR80 and US 191.

√ Approval of location for the fireworks display during the 4th of July celebration.
