Brokers, exporters affected by new trade regulations

New regulations have been implemented for brokers and exporters whose merchandise is headed southbound into Mexico. In fact, the regulations will affect all 240 trading partners with the United States.

As of July 2 Shipper’s Export Declaration must be filed electronically, said William G. Bostic, Jr., chief of the Foreign Trade Division of the US Department of Commerce.

Before crossing the border, the driver must have an Internal Transaction Number generated from the Automated Export System as proof of filing the required export information.

Typically, the driver would have dropped this information at a mailbox at the southbound lane at the port of entry. With the new regulation, the driver must have that information electronically mailed no later than one hour before he is about the cross the border, Bostic said.

There is an exemption for carriers with $2,500 or less in merchandize.

Bostic said that those people affected have until Sept. 30 to comply.

The Census Bureau has instructed filers of export information to make every effort to submit the data through the Automated Export System or AESDirect to eliminate the use of paper SEDs immediately.

Anyone submitting paper after Sept. 30, 2008 will be in violation of the FTR and subject to penalties.

The Census Bureau can assist brokers and exporters of the new Foreign Trade Regulations and filing export information electronically through AES.
