State cites video evidence that Mexican students being accepted by Omega Alpha

Two weeks ago, State School Superintendent Tom Horne charged that a border charter school was accepting Mexican students.


Today, he released video evidence that demonstrates conclusively that, contrary to previous denials, the Omega Alpha Academy charter school in Douglas is accepting students who  reside in Agua Prieta, Sonora, Mexico.

 In 2008, the school was questioned by Arizona Department of Education (ADE) staff following allegations that the school enrolled students who actually  live in Mexico.  Omega Alpha provided documentation that claimed each of their students is an Arizona resident.  The Executive Director of the school, Jose Frisby, wrote ADE a letter stating in part that, “before we enroll any student, we require that the student verify his or her Arizona residency.  When a student’s family cannot provide any of these records… we obtain a certified statement from the Arizona resident with whom the student resides.”

 Additional and more detailed allegations came to light in April of this year, and ADE sent a staff member to videotape conclusive evidence.

 Horne stated, “Contrary to previous denials, Omega Alpha Academy is accepting dozens of students who do not live in Arizona.  Videotaped evidence shows students being transported to and from school in several large passenger vans filled with Omega Alpha students that move directly from the school to the Mexican border in the afternoon and directly from the border to the school  each morning.  The scheme is open and blatant.  Since these vans operate either on school property or in areas immediately adjacent to the property, in full view of school staff, in order to pick up and drop off students, it is impossible that school leadership is unaware of this practice.”

 Horne added, “Previously, ADE put a stop to this practice when it occurred with district schools.  However, we have been informed by the Attorney General’s office that charter schools are exempt from the provisions of A.R.S. §15-823, pursuant to A.R. S. §15-183(D)(5).  We therefore respectfully request that the Legislature immediately pass a law making A.R.S. §15-823 applicable to charter schools.  We also request that there be an emergency clause so that we can stop making payments as soon as possible.”

I feel for Mr. Frisby and what he is up against (disloyal employees). He is a good administrator and a family man. However, Charter schools should follow the same laws as in "The Public Schools." Teacher's should not serve on the board because it's a conflict of interest. How can any decisions be made. Charter schools funding is tax payers monies and this limits our public schools budget.     " Many complaints have been made to the state dept of education about the charter schools breaking this law. Unfortunately, it is has taken them so long to do something about the problem. For at least a year, a bus picked up kids from the border and took them to Omega, then returned them at the end of the day. I hope CAS is next! When the DUSD discovers a student illegally attending school, they withdraw the student from school. It happens regularly. They even send security personale to verify addresses. Charter schools have been a long time blight on public education. They are supported by politicians and political parties that want to do away with nationalized education. Charter schools do not have to operate under the same guide lines that the DUSD and other districts follow. That is why they are performing plus and excelling. They are compared with substandard guidelines. They are a cheaper version of a public school. "

    " Yes I go to DHS and I know of some students that are from AP but I also know they pay tuition. One of them got caught lying about where they live and now they have to pay to come to school.But I know DHS is always checking where you live because my friends have been called into the office when their addresses are being checked. I also know kids that go to Omega and they are there because they were kicked out of DHS for not living in Douglas. This is the truth because we party in AP with them and they told us it's easy to be in omega no one checks for their address. "

And as a student you know whats going out with the school and i can say that this is stupid because if it was something illegal to go to school to Douglas while liveing in A.P. (mexico) you dont think the border suppervisiors would of already had this noticed to the state? Well its seems all this is only Hate, Selfishness, or i dont know what but this will probably be from a FIRED TEACHER? from ANOTHER PRINICPAL FROM ANOTHER SCHOOL?

    And for last, I dont think this will affect the school at all!, because the standarts and the education they give its excellent! and the director "Mr.Frisby" is a man that knows how to do its job. "

The state says the kids have to be allowed to enroll in school and then be given 30 days to prove proof of residency. Why not make them show it upfront.
