For the second time in less than a year, Douglas Unified School District Superintendent Earl Pettit was placed on paid administrative leave by the district.

The District Governing Board voted on Tuesday evening to place Pettit on leave until the end of his current two-year contract, June 30, 2010.
It will cost the district approximately $51,000 to send Pettit home for the remaining five and a half months of the contract.
The 3-2 vote (Board President Charles Hoyack and members Ed Rivera and Patricia Lopez voting for the move, and Susan Kramer and Mario Ramos against it) came near the end of a four-and-a-half hour meeting.
The board also discussed and approved the release of the redacted 300 page plus investigative report on the Superintendent.
Earlier in the day, Pettit’s attorney Gary Lassen filed a 43-page lawsuit in U.S. District Court against Alvina Hoyack, Charles Hoyack and Ed Rivera in addition to John and Jane Does that may be added later.
The lawsuit alleges Free Speech Retaliation, Due Process Liberty and Property Interest Violations, Defamation and False Light, Interference with Employment Relationship, Intentional Infliction of Emotional Distress, and Liability for all defendants for Violation of the Racketeer Influenced and Corrupt Organizations Act, Violation of the Arizona Open Meeting law and Violation of civil and constitutional rights.
While the suit does not seek a specific damage amount, the suit asks for physical and emotional damages, necessitating treatment that is continuing and expected to occur due to economic damages caused by the Defendant’s intentional acts acting in their personal capacity; attorney’s fees; punitive damages; and removal of Hoyack and Rivera from board positions.

Everyone please call the attorney general and ask him to get rid of these board members quickly before they bankrupt the district. As for all the people commenting in support of the board actions please explain how they can make no comments publicly or explain their actions publicly. They owe us that much. Apparently Rivera and Lopez don't even want to turn over their e-mails. There are no excuses for this behavior.
Please don't complain about one sided reporting when one side(the side with an obligation to answer to the voters) isn't commenting at all.
How can you start termination proceeding on a superintendent so shortly after hiring him and then not give specific, concrete reasons why and not expect to get sued. Of course it was personal. Why not open it up and discuss the personal stuff that led to this. The letting go of board members wives. Other wise we are just dancing around the truth misspending a lot of money. "

It is apparent the board did not apply progressive discipline in writing. They should have put an end to unacceptalbe behavior early on by following a policy that requires verbal warning (showing concern but no anger), written warning, suspension and then termination. The goal is that nobody's surprised when you do the deed. I feel you can skip the normal process and fire employees immediately if endanger security (threatening violence), safety (refusing to wear protective equipment, and school property (an angry outburst that damages chairs, desks, computer, etc.

These three better not ask us to pay for their attorneys now. They don't comment about this, they don't answer to us, don't allow public comments at their meetings, and don't ask voters in conversation for our opinions now they better not ask us to pay for their attorneys. They probably will. The law or statue is ARS-38-431.07
Considering they have the three votes they may try this. I hope they are removed from office before. "

Douglas wake up and put people on the school board those who seek the right agenda, STUDENTS! Where did this community go wrong? Students are the sole purpose of education not one's own agenda.
Bullies would be prosecuted if they where students. Hoyack cronies should be held personally liable for all fees incurred by the district when the truth comes out. Since those of us who choose to see the students come first know this is just a witch hunt. "

If Terry Goddard wants votes from Douglas in his run for governor he should investigate this and remove Hoyack, Rivera, and Lopez from office if KGUN is correct in its reporting. The arrogance and disrespect for their constituients of these three to not answer to the public is disgraceful. Don't hide behind attorney-client privilege while spending taxpayer money on what appears to be personal vendettas.
If you want him fired tell us why specifically before you expose us to potentially very expensive litigation.
I would rather you use tax money to buy textbooks, allow kids to play sports, or a whole bunch of other productive investments not pay our superintendent to watch soap operas, make payments on a lawyers mercedes, or to massage board members egos. "
