Pettit files $2.5 million claim

Douglas Unified School District Superintendent Earl Pettit, has filed a second claim against the district for $2.5 million


The claim is the first step prior to filing a lawsuit against a public entity.

Typically, the claim is turned over to the Trust (District liability insurance company) and they have 60 days to determine whether the claim is valid or not. After 60 days, the complainant may file a lawsuit against the district if no settlement is reached.

The claim was announced mid-week on a Tucson television station, prior to the time that the plaintiff’s had received any notice of the claim.

As of Friday, February 12, neither the district office nor Board president Charles Hoyack had received any written notice from Pettit’s lawyer, Gary Lassen.

Pettit was placed on administrative leave several weeks ago when the Douglas Unified School District voted 3-2. Former School District Superintendent and Department of Education Deputy Ray Borane is now serving as the district’s Chief Administrative Officer.

The 16-page claim calls for the immediate resignation of DUSD Board members Charles Hoyack, Eddie Rivera and Patricia Lopez.

In dollars and cents, the claim asks for damages to Pettit in the sum of $2 million and an additional $550,000 in legal fees.

Most of the accusations made in this latest claim is a result of the investigation, which Pettit and his attorney, Gary Lassen, say vindicate him, and the action to place him on paid administrative leave.

They claim it was done:

√ In violation of the open meeting law

√ Despite a questions of confidentiality surrounding the board

√ Administrative leave is by definition a “disciplinary action.” It requires cause and it requires a resolution with due process being provided.

√ Action was retaliatory.

√ Extended leave is a violation of due process in and of itself. The reliance on a contract provision that allows for reassignment during its term is misplaced.

√ The board has no authority to take action based on a report that was accepted and prior action admitted no reason existed for additional action.

√ The action constitutes interference by Deputy County Attorney Anne Carl and Hoyack’s continuing exercise of authority in excess of that provided him by law or policy.

√ The action was conducted with “evil mind” as perpetrated by Hoyack, Lopez and Rivera in furtherance of an illegal enterprise and with the intent to defame and cast Mr. Pettit in false light, and to intentionally inflict emotional distress upon Mr. Pettit.

Much of the claim looks at the investigative report filed by Patrick Cooper, which they claim found no wrongdoing.

While the report itself found no legal evidence, Cooper did say during his oral report to the board he was concerned about both reading district communication and the “hostile” environment.“

During that December meeting, Hoyack said that while he did not violate district policy, Private Investigator Patrick Cooper indicated several concerns and a “grave concern” concerning reading of district communication.

During the 45-minute report on this investigative findings, Cooper also said that 72 percent of those interviewed felt that there was a hostile environment in the district.

At the board’s next meeting, Hoyack echoed those same concerns when he asked for Pettit to be placed on paid administrative leave.

In the claim, Pettit and Lassen claim “toward the end of the investigation in December 2009, Ms. Carl intercepted the report before the board got a chance to receive it in the absence of any express authority to do so.”

Lassen in the claim states “The board, without cause and contrary to law, has taken action to non-renew Mr. Pettit’s contract after its expiration…District breached Mr. Pettit’s contract by not providing an evaluation as required under the terms of his contract and district policy on or before December 18, 2009. This and other failures at a minimum obligate the district to extend Mr. Pettit’s contract through June 30, 2011.”

The claim is dated February 8, 2010, but since it is unclear when it officially reached the district, it is difficult to determine an exact date when the claim must be answered, but the district would have to have some answer probably by mid-April.

We now have Mr. Borane and Mr. Hoyack who are here to help our community, protect the kids of the Douglas School System from the heart. Mr Pettit was just not right for the school system certainly not as the Superintendent of Schools, and I’m glad he is gone. If there is a conflict of interest with him and Human Resources what was Mr. Pettit’s real intentions? I agree with “what” in that Mr. Pettit was the worst Superintendent for the school systems of Douglas. I think he brought all of this on himself and maybe intentionally. Mr. Pettit was a bully and only wanted to muscle up push the system and Douglas around and only on his terms. Did he make decisions? Sure, that was his job. Was he a good communicator? No, not even close, and communicating is very important when dealing with parents and their kids, something he knew absolutely nothing of, and he showed it when he was around us. Shrugged off parents, snickered anytime someone said something against him or what he did not like, he would mumble things where you couldn’t hear him, and tried to stare others down, along with rolling his eyes and making it obvious he did not like the person, and was not interested, he was the worst Superintendent ever. Mr. Pettit did not want to stay here; he did not care about Douglas and only was successful at one thing, pitting Douglas citizens against each other, and that in itself is wrong. He was wrong for the schools and wrong for Douglas. Think about the kids if anyone decides to write on this article, that’s all Douglas wants. Let’s get past the bad Superintendent we had and allow Mr. Borane and Mr. Hoyack to do their job and work for the kids. I am confident these two men will keep the school system working for the kids the way it suppose to, and we as a community need to support them. It has to be for the kids "

    " Get the facts- If you say the Hoyacks ruined Mr. Pettit's name what about Whiteriver? Is there a conspiracy for everyone to get Pettit? Get a grip. Mr. Pettit hurt his own name because of the way he acted. Did Mr. Pettit make some good decisions for the schools, yes. That was his job. Did he do things that were not productive and harmful to the district, yes. Some people talk about the investigation and say that he was cleared but that is not true. There were many items that were sent on to more qualified people. Also the investigator only looked into that issue. From what I have heard people at every school said he was never visible and his decisions caused problems. Mr. Pettit couldn’t work well at the last district and the same thing happened here. He brought in Mary Good whom worked with Mr. Pettit in Whiteriver and got a job here when he left. If you have a good job why would a person follow another? A personal relationship between the superintendent and a person in human recourses I think is a conflict of interest. As for the ELL situation Stevenson did nothing wrong each parent has a choice to remove their child from the program. I know of a student who was removed and she speaks perfect English. I have never met either Mr. or Mrs. Hoyack but have watched the board meetings and the only person that has acted inappropriate was Mr. Pettit. He has acted very disrespectful by rolling his eyes, making faces at people, and making comments. "

    " Sorry people, but you're all as dumb as a box of rocks! The people in the school board should be professional business people looking for the best interest of the students and staff. Of course, we all know you lack people of that level in Douglas so this is what you get: a bunch of uneducated, disqualified, and power-hungry high school chicks and jocks. I mean this is what your city is. The people in charge of your city are grown up high school cheerleaders and football players that couldn't get out because they didn't have the brains to actually pick up a book and read it and instead just started breeding (barf). Anyways, someone is probably going to respond to this probably saying " Who do you think you are!" or "Mr. Hoyack is a great man how dare you!" or even better "We are good people may God forgive you!" (realling barfing now). My suggestion is maybe you should stop giving out your opinion like it even matters and enroll into some courses online or something. OH and you got to give it to Pettit, he's a smart man for suing. Although, I'm sure he didn't come up with that idea.

    P.S. Douglas Dispatch needs to pick up the pace with their website. You might want to look into investing time and effort into it. After all, it is 2010.

That is grossly irresponsible. I don't care how often you go to church. I have not heard them make one public comment They owe the voters at least that much. They can conspire behind people's back and talk behind people's back but not explain their votes. How can you defend that. It is pathetic. I hope they are removed from office, get dragged through a lawsuit, and fined for their blatant violations. Lopez also but she would do whatever they told her.     " First I would an apology to Mr. Hoyack, his wife Alvina and family, and Superintendent Mr Borane. It is a real shame this issue has taken on the life it has, neither of you deserve this from the community you protected and help in many ways.
    To my fellow community members: “Snake oil salesman” pretty much sums up the kind of person Mr. Pettit is. I am not a parent, don’t have kids in the schools, but I am a tax payer and I know both Mr. Hoyack and Mr. Borane very well. For all I know, you probably received help or know someone how received aid because of the 24 hour annual program Mr. Hoyack and his family have organized here in Douglas. I know for a fact how both Mr. Hoyack and his wife (Alvina) have worked days on end to bring together the 24 hour annual program so that others in Douglas could receive the care and attention they need. I know for a fact how hard they worked for you, as I worked with them side by side from year to year. I’ve seen how Alvina has gone out of her way to help families around Douglas, take a moment from her day to help out a family with her family.
    Mr. Borane needs no introduction, he has done what he could in the little time he had as Mayor to try and put Douglas on the map and join surrounding communities so that Douglas with have some voice and try to stand out with the rest or above the rest. This town is our town, it’s all we have and those of you with a negative opinion probably sit there and tell others how terrible Douglas is when you are probably part of the problem, or at least add to it. We don’t know what happened with Mr. Pettit and the Board, and you the community have allowed yourself to only believe what the Tucson news brain washed you with.     " Where did you get this information? I would start to get it somewhere else. Since Mrs. Overman has started at Huber things have been fine.     " First of all, they didn't use that classroom for any science projects this year! It is not a science classroom it is an 8th grade class. Why would Mr. Muecke hold the buck when as soon as he knew about it reported it? The “trade” is not really what it is… Mrs. Overman is the principal of both Clawson and Huber Middle School. Mr. Muecke is at Clawson but not as principal. I do not know what his job there. The day that this was found there were NO experiments and a student did not bring in one gram of Cocaine as a prank, or to get the teacher in trouble. I spoke to an officer Monday morning and find it interesting that the police said that they could arrest the assistant principal for holding the Cocaine (possession, and failure to report), but the one in trouble now is the principal? If the assistant principal had reported this on the 12th, then the police could have looked into this and might have found who it belonged to. Since he concealed this from everyone for more than a week the police said they could not do anything. You can go to the Douglas Police Dept and ask for report # 10-0545. I went to get one Monday and didn’t know the number and they were able to figure it out. In that report is says that the case was closed but not cleared (on 2-18-10). I urge the citizens of Douglas, and the people who have followed everything regarding Douglas to ask why the wrong person is being punished. Nothing happened to the teacher and possibly nothing will happen to the assistant principal who failed to report this and put kids at risk. Why would the assistant principal not report this to the Interim Superintendent, the principal, or us as parents that have students in that class? It is weird that Mr. Borane was not told about this until Thursday or Friday, over a week. The only reason he knew was because Mr. Muecke notified him. I have spoken to Mr. Muecke regarding this teacher before, and he for the most part was helpful. That is fine if Mr. Borane would like that punishment for Mr. Muecke, but the assistant principal should at least receive the same punishment. If not the assistant should have a worse punishment! I have 2 children in this school, one that will be leaving at the end of this year and another that will be there longer. I will do whatever it takes to have this blame placed where it should, with the assistant principal. The assistant principal should be given a worse punishment, and if not then equal would be better then what is going on now. I do not trust the assistant principal with my children and am afraid of what other decisions he will make. "

It took a week later when the two security guards took it to the police dept to get it checked and the police officers stated Dunlap could be charged with knowing of the possion. How is it that Meueck gets transfered due to his lack of knowledge? I feel Dunlap should be charged or demoted for knowing and handling the situation very irresponsible.Dunlap had it on his desk for a whole week and any of the students could have walked into his office when he wasn't around and could have taken it...     " I think the 2.5 million sounds reasonable considering. They ruined this mans professional reputation. He can't get another similiar job in all likelihood. If he has 10 years worth of work left at 200k a year total. That means salary, benefits, social security contributions, etc... that alone is 2 million in real damages. Then tack on punitive(punishment) damages, the cost of all the therapy and medical treatments resulting. It seems reasonable. Not joking. If there is a lawsuit he will ask for a lot more.
    If they had real reason or at least made a real argument for sending him home this could have gone away. They won't even comment on it. It is disgraceful. If nothing else they could have just let his contract run out and sent him packing. This was personal and vindictive not to mention dumb.

    " Why is everyone applauding Borane for working for $1. It looks like the Hoyacks want to run the day to day of the district for free. He seemed to be involved in everything and wanted to be informed of everything and Alvina ran Stevenson. Tell him to step down and apply for the job.
    After watching the Ortiz interview and seeing the report on the website I can't believe Hoyack and Rivera went to the lengths they did to protect him. First Hoyack should have abstained because his wife was in the middle of it and Rivera should have never "demanded" an apology and reinstatement of anyone. They should have applauded Pettit publicly and agreed with the termination. Ortiz was putting the district at risk of State intervention and loss of $$. That isn't my opinion it is the result of the short investigation and opinion of Pettit, the compliance officer, and the state observer. Talk about disregarding facts for personal agendas. Now the district will pay and please don't say the insurance company will and the district won't.
    I regret the bond issue. I don't trust this board with one dime. Until Hoyack, Rivera, and Lopez are gone I will not give the district another dime in donations, votes on bonds, and will only hesitantly pay my property tax portion that goes to schools. I will seperate that amount and send it seperately. I also don't want my tax dollar going to pay the salary of Hoyack(college) and Rivera(County). They should work for free(if they keep their jobs) until all the legal fees and settlements are paid. "

Up pity’s disliked you because you dared to not give in to their wants. Now that the investigation is out it is even more revealing that you had not only Hoyack undermining you, you had your secretary, and some directors too. What a shame. Please don’t think that the few bad apples are what this town is about. It is a good place to live and I hope there is a way that you will be able to come back. I also see you with your kids sometimes when I’m getting mine, and I see the parent side to you and how good you are. Good luck to you Sir and don’t give up.     " One must wonder at the source of the hostile environment which cause Mr. Petit to react. Perhaps the hostile environment was already abrew when tempers flared. As to the reading of emails...every person working with today's technology should know that your work email is always under observation and may be monitored at all times and called into review for any reason at any time. Remember your kindergarten rules...if you don't have anything good to say about someone, don't say anything.
    If it were me, I would pay the suit and cut my losses. There are quite a few people out here in the netherlands of Douglas, who for more reasons than are able to print, have wanted to recall Hoyak and have not done so due to the cost to the school district in performing recall. Well, maybe we should have recalled Hoyak and saved the district more than the $2.5 million Mr. Petit is asking for. By the time this is all said and done, court costs alone, which are sure to be aborbed by the district could have paid for 1000 children's Bachelor's degree from Harvard...well that may be a slight exageration. Is this report an example of why some of the people in Douglas didn’t like Pettit, because he was visionary, a hard worker, and thought outside the box. At the last Board meeting some guy was there to talk about a superintendent search and said the Board didn’t have to hire someone with a superintendent license. You seem perfect for Hoyack .
