Lindemann retains seat after final results released

Incumbent Mitch Lindemann has reclaimed his seat, at least for now, following the release of the official voter tally on Thursday from the Tuesday, November 9 election.


In the unofficial results released on Tuesday, Lindemann fell to Richard Lopez in Ward 2 by a count of 67 to 61, while Ray Shelton narrowly kept his position in Ward 4 by a vote of 105 to 98 over Frank Ambriz. Quinonez easily defeated Jose Acedo in Ward 6 by a total of 83 to 41.

Shelton and Quinonez both increased their leads after the final tallies were released -- Shelton winning 114-101 over Ambriz, and Quinonez 90-42 over incumbent Acedo.

But in the Ward 2 vote, Lindemann gained 8 votes while Lopez only 1.

Those new votes were due to provisional ballots and early ballots not counted on Tuesday.

Provisional Ballots are those that officials have initial concerns about, and the Early ballots were those that were turned into the polling places on Tuesday instead of mailed. If an early ballot is received after the polls close, it cannot be counted.

Brenda Aguilar, City Clerk, said a meeting will be called next week to canvass the votes.

No date has yet been set for that special meeting.

At that point, it is likely that City Attorney will petition the courts for a recall in Ward 2 since only one vote separated the two candidates.

It is then up to the court to order a recall.

    " I cannot believe that Shelton or Lindemann won by a few votes and some that were brought in as "provisional" give me a break,this is a sure case of corruption. A recount of all votes for these two positions should be held. We must be able to be certain that the right people are in office. If it's Shelton and Lindemann so be it but if it isn't then the people must do what is legally right. "

    " Cochise County has a duty to the its public to insure that all these “provisional” votes are carefully and accurately counted. Lopez was clearly the winner for straight forward 100% valid votes. Then some 20 hours after the poles close some “provisional” votes surface to reverse the outcome is truly a come from behind miracle. These controversial “provisional votes” should demand the highest level of scrutiny by every election official. Anything less would be an outrage to the American public. "
