Garcia was shot with a .22 caliber rifle in the left thigh on May 1, 2009.
According to a court document, the shooting occurred during an arranged fight. Lopez acknowledged he had a firearm and fired it.
“The defendant asserted, however, that he fired the weapon only in an effort to break up the fight and did not intend to harm anyone who was present, including the victim, Erick Garcia,” it states.
Attorneys had stipulated Lopez would serve a term of nine years in prison. Division 3 Judge Wallace Hoggatt agreed with the stipulation and he sentenced him to that period.
