The third recall attempt against Ward 2 Councilmember Mitch Lindemann is still in process of being reviewed by the Douglas City Clerk Brenda Aguilar and the Cochise County Recorder Office.

After receiving the serial number the group had by law 120 days to collect 35 signatures, term that would ended on March 3, 2012. Aguilar also confirmed that they actually filed their petitions already.
“They came in on November 22, filed the petitions and they have approximately 75 signatures,” Aguilar said.
The following step for the recall is to get an initial review by City Clerk. “I have ten days from the date that they filed or submitted the petitions to me to review them,” said Aguilar. “Once I review them I have to submit them to the Cochise County Recorder’s Office and they have 60 days to certify signatures.”
Once the Recorder’s Office certifies the signatures and they submitted back to the City, Aguilar has to determine if there are sufficient signatures in order to call for an election. Lindemann is currently serving a four-year term which expires in 2014.
Since the times for the next election are so close, in case of not having a result soon enough to include Ward 2 on the March elections if Lindemann is recalled, this special recall election would take place on May, 2012. At this point it would an additional cost to the City, which amount to $6,000-$8,000.
The third recall came after group Truth for Douglas having Olga Robles as Chairman and Derek Garldand as a Treasurer. The documents presented for the recall states partially that
“We the Citizens of Ward 2 want Councilman Mitch Lindemann removed from office. He has violated the civil rights of his constituents by not allowing citizens to speak at the public sessions of City Hall Meetings.”
Councilmember Lindemann said in previous days that he is aware that a third petition of a recall against him has been filed but he feels confident that the people that are behind it will not have success again.
“Go ahead!” Lindemann said. “I will win. I have a lot of support from my district, so I am not worried.”
Lindemann also said that in the previous recall attempt he discovered a flaw, which led him to take this issue to court and spend $6,000 out of his own pocket in order to save this money to the city. “This new recall is being brought by the same people with the same lies,” he said.
