DUSD lawsuit dismissed

A lawsuit filed by former Douglas School Superintendent Earl Pettit against the Douglas Unified School District has been dismissed without prejudice.

A motion filed by Charles Hoyack, Ed Rivera, Patricia Lopez, Susan Kramer, Mario Ramos, Douglas Unified School District 27 and Anne Carl, Cochise County Deputy County Attorney to dismiss Pettit’s lawsuit was granted recently by Cochise County Superior Court.

The court document states Pettit must pay $25,000 in attorney’s fees and $25,000 to the defendants a total of $50,000.

Current DUSD Superintendent Sheila Rogers said she had no comment on the matter since all this was done before she became superintendent.

 

According to Douglas Dispatch archives the case started in 2009, when the Douglas School board removed Pettit from his position as superintendent.

A $40,000 investigation followed and cleared Pettit of violating any policies, but the school board still chose to relieve him of his duties placing him on administrative leave.

Pettit’s lawsuit claims the school board violated the open meetings law, by discussing his proposed removal as superintendent behind closed doors. He was also suing for violation of open record laws, violation of his civil rights and defamation.

Pettit is reportedly appealing the judgment handed down by Superior Court Judge John F. Kelliher, Jr.
