County rancher must pay punitive damages

Cochise County rancher Roger Barnett cannot escape paying punitive damages to border crossers he kidnapped despite a 2011 state law passed specifically to help him, a federal judge has ruled.

Frank Zapata acknowledged that Arizona voters approved a measure in 2006 which constitutionally spells out that anyone not in this country legally is ineligible to collect punitive damages after winning a lawsuit.

That, however, came too late for Barnett who was sued following a 2004 incident when 16 illegal immigrants said the rancher illegally imprisoned them while they were crossing his property. One woman also said she was kicked.

So last year, the Legislature voted to make that ballot measure retroactive to the start of 2004.

Armed with that law, Barnett went back to federal court to void the $60,000 in punitive damages that four of the plaintiffs were awarded two years ago.

Zapata rejected the arguments.

The judge, almost in passing, said in a footnote that he accepted the arguments of attorneys for the plaintiffs that the 2011 law is unconstitutional. But Zapata said he could reject Barnett’s arguments on more basic grounds: If lawmakers were trying to help Barnett, they did not do it right.

The judge pointed out that the constitutional language says those not in this country legally cannot be awarded punitive damages.

But Zapata pointed out that the question of punitive damages does not arise until the case is finished and a defendant is found liable.

More to the point, Zapata pointed out that when a different judge awarded punitive damages in February 2009, three of them were lawfully present in the country. And a fourth, the judge said, had returned to Mexico after she was allowed to be present to testify at the trial.

“Therefore, when punitive damages were awarded, none of the plaintiffs were present in Arizona in violation of federal immigration law.’’

During the 2011 legislative hearing, Rep. Jim Weiers, R-Phoenix, said helping Barnett was exactly what he had in mind.

He said the 2006 constitutional amendment, referred to the ballot by the Legislature, was a direct reaction to the fact lawmakers knew Barnett was being sued.

“We weren’t smart enough at that point to understand that there was going to be a time lapse,’’ Weiers said at the time, making Barnett unable to take advantage of that change.

Zapata, however, said all that is legally irrelevant. He said that judges are bound to follow the words lawmakers put on paper — and into the statute books.

“If we find no ambiguity in the statute’s language, we must give effect to that language and we may not employ other rules of construction to interpret the provision,’’ the judge wrote.

Weiers argued at the time that the restriction against punitive damages makes sense.

“How incredibly silly that you’ve got people breaking the law, trespassing, doing this and that on personal property, and then you’re handed punitive damage awards,” he said.

Barnett’s separate efforts to have the entire verdict overturned have proven no more successful. The 9th U.S. Circuit Court of Appeals rejected his arguments that the trial judge should have told jurors they could consider his claim of self-defense.

    " I think it is simplistic to say just call the officials. It could have been a long time before they arrived. He did not harm them. He was making a citizen's arrest...trespassers on private property... One never knows who might be in an illegal group. One day I looked on my front porch and saw 2 young men dressed in black and wearing black caps. They were sitting on the porch furniture acting like they lived here. I did not apprehend them because I was inside the house and did not want to go outside. I did call the officials and it was a while before they came. By that time the 2 had disappeared. As it turns out, they escaped from a van that had been stopped because they were transporting illegals. These 2 could have easily broken into my house...Then they would be corpses. They could easily have criminal records. Those who wrote above that they are just looking for work are really hiding their heads in the sand. It is a huge problem!!! Do I think that he has had every right to hold people not knowing what threat they are to him/his family/property, at that time (basically finding them in his backyard), yes. I AGREE with ALBERTO. As for saying we shouldn't take the law into our own hands and should move to Florida, what about the many stories where taking the law into your own hands has saved lives or caught people that would have been gone by the time the police arrived??? For instance a Utah man on May 1st, stopped more people from being stabbed inside of a store, because he had a concealed weapon permit and held the suspect at gunpoint until police arrived? Barnett does/did call the Border Patrol. Does he make comments that might have frightened the illegals? Probably, but if someone was in my backyard or house, I would probably do more then just hold them until the Police/Border Patrol got there. Esp. not knowing who, what, or why they were there. These are dangerous times and people need to protect ourselves as citizens of this country (our right, given to us by the founding father's). Yes you can say many illegals just want to come to work and make a better life for themselves (I agree), but what about the others that have criminal records, are on watch lists and aren't allowed in the country for good reason? We need to control who is coming in and out of our country to protect the actual citizens. "

BUT we all know here in Douglas that he protects his property vigorously, it’s no secret. The illegal aliens that crossed through his land on that day found out the hard way, but in the end, it is HIS land. The U.S citizens that were caught with the illegal aliens were smuggling them into the U.S., so sorry, they deserve no sympathy, just jail time. If we think that these illegal aliens don't know the risks of entering our country, we are sadly mistaken... anyone not breaking the law has nothing to worry about because these things will not happen to them, but if you CHOOSE to break the law, be prepared to deal with whatever consequence you are going to be dealt. There are millions of immigrants that came to this country legally and take pride that they became U.S. citizens the right way... EVERY single person not doing the same to become a citizen of our great nation is a disgrace to those that have. P.S. I am one of those immigrants that have become a citizen correctly, so stop the U.S. bashing or leave and let someone who wants to be here take your place! "
