Mistrial in Ysea drug case

A Cochise County Superior Court Judge declared a mistrial in Israel Ysea’s drug case. Ysea has been charged with marijuana transport and or sell, attempted marijuana possession for sale, hindering prosecution and first degree conspiracy.


Ysea’s trial was set to begin on Jan. 22, 2013. But due to jury complications his trial date had to be rescheduled.

Court documents state an alternative date was presented to Ysea, but these dates are outside the speedy trial deadline.

Mr. Thomas Holz, Ysea’s court appointed attorney, advised the court that defendant was not willing to waive time and would like a trial within 60 days.

According to court records the defendant was advised that another date may be given but the case may have to be transferred to another division to make sure the trial is within the time or is as scheduled.

Mr. Holz stated that defendant prefers that case stays in this division and is willing to waive time until April.

A Jury Trial is set for April 23 – 25, 2013. The first day of trial will begin at 8:30 a.m. in the absence of the prospective jurors. Subsequent days of trial shall begin at 9 a.m. unless otherwise directed.

Ysea again appeared in court on Jan. 25, 2013, but this time for the alleged murder of Guillermo Cruz on Oct. 17, 2012.

Ysea is being charged with premeditated murder in the first degree, murder in the second degree, burglary in the second degree, and possession of drug paraphernalia.

Trial for these charges will begin on July 15-18, 2013.
