Douglas man now facing murder charge in death of 2-year-old

A Douglas man, who had been arrested after he allegedly assaulted a 2-year-old, has had a second-degree murder/intentional death charge added to the previous felony charge of child abuse/domestic violence after the child passed away Tuesday, Jan. 7.

According to Carol Capas, spokesperson for the Cochise County Sheriff’s Office, on Sunday January 5, at approximately 6 p.m. the CCSO arrested 21-year-old Mario Alberto Toscano Jr. at his Douglas residence and booked him into the Cochise County Jail on felony charges of child abuse/domestic violence.

Capas said the Sheriff’s Office was initially contacted by the Douglas Copper Queen Hospital Emergency Room at approximately 10:15 a.m. that morning in reference to a child who was not breathing and suffering from questionable injuries. Medical intervention occurred and once the child was stabilized he was transported to a Tucson hospital for further treatment.

Deputies interviewed medical staff, the mother of the child, and Toscano before serving a search warrant on the residence in Douglas where the mother and Toscano live.

As a result of information obtained in the investigation, Toscano was arrested and booked in the Cochise County Jail pending further adjudication.

On Thursday, Jan. 9 the Cochise County Grand Jury indicted Toscano on the additional charges.

He remains in custody at the Cochise County Jail.

The investigation is being continued by the Cochise County Sheriff’s Office.
